Termini e condizioni di vendita

Article 1 — Purpose

These Terms and Conditions of Sale (TCS) govern the contractual relationship between Beachman SAS, SIRET 101 018 489, hereinafter referred to as the “Seller”, and any consumer making a purchase on the website www.beachman.eu, hereinafter referred to as the “Customer”.

Article 2 — Products

The products offered for sale are those displayed on the website at the time of the Customer’s consultation. Beachman reserves the right to modify the product assortment at any time. Each product is presented with a description and photographs that are as accurate as possible.

Article 3 — Prices

Prices are shown in euros (€), including all taxes (VAT included). Beachman reserves the right to modify its prices at any time, it being understood that the applicable price is the one in effect at the time of order confirmation. Delivery fees are indicated separately before order validation.

Article 4 — Orders

The Customer places an order online via the website. The sale is concluded upon receipt by the Customer of the order confirmation email. Beachman reserves the right to cancel or refuse any order in the event of an existing dispute with the Customer or suspicion of fraud.

Article 5 — Payment

Payment is made online using the methods offered on the website (credit card, etc.). Payments are secure. The order is processed after payment confirmation.

Article 6 — Delivery

Products are delivered to the address provided by the Customer when placing the order. Delivery times are given for information purposes only. In case of delay, Beachman EU cannot be held responsible. Transport risks are transferred to the Customer once the products are handed over to the carrier.

Article 7 — Right of Withdrawal

In accordance with Article L.221-18 of the French Consumer Code, the Customer has a period of 14 days from receipt of the order to exercise their right of withdrawal, without having to provide any justification or pay penalties.

Return shipping costs are borne by the Customer unless otherwise stated. Refunds will be issued within 14 days following receipt of the returned products.

Article 8 — Legal Guarantees

All products benefit from the legal guarantee of conformity (Articles L.217-4 and following of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 and following of the French Civil Code).

Article 9 — Liability

Beachman cannot be held liable for damages resulting from improper use of the purchased product. Beachman’s liability is limited to the amount of the order.

Article 10 — Personal Data

The data collected during the order process is necessary for its processing and is intended for Beachman. In accordance with the GDPR, the Customer has the right to access, rectify, and delete their data by contacting: france@beachman.ca

Article 11 — Mediation

In the event of a dispute, the Customer may use a free consumer mediation service. Beachman is affiliated with the following mediation service: [Mediator name and contact details]. The Customer may also use the European Online Dispute Resolution platform.

Article 12 — Governing Law

These Terms and Conditions of Sale are governed by French law. In the event of a dispute, French courts shall have jurisdiction.
